This page contains SoulArt’s legal terms for using our website, buying products, requesting custom artwork, and interacting with our content. It also links to our Privacy Policy, which explains how we collect and use personal data.

1) About these terms


These Terms govern your access to and use of SoulArt’s website, services, and any purchases made through our shop.

“SoulArt”, “we”, “us” means SoulArt (India). “You” means any visitor, customer, or user of the website.

By accessing the website or placing an order, you agree to our all Terms - Conditions and confirm that you are legally capable of entering into a binding agreement under applicable law.

If any part of these Terms conflicts with a written agreement signed by SoulArt, the signed agreement will also control for that specific subject.

2) Using the website (acceptable use)


You agree not to:

  • use the website for unlawful purposes, fraud, or harmful activity
  • attempt to gain unauthorized access to accounts, payments, admin areas, or systems
  • copy, scrape, or harvest data (including email addresses) without permission
  • upload malware, spam, or content that disrupts services
  • impersonate someone else or misrepresent your identity

We may restrict or suspend access if we reasonably believe there is a security risk, misuse, or violation of these Terms.

3) Orders, pricing, and payments


Pricing: Prices are shown on the website and may change without notice. The price charged is the price shown at checkout at the time the order is placed. Prices are shown are Ex-place, without taxes and logistic.

Taxes: Prices are shown excluded all taxes. Where applicable, taxes (including GST) may be added at checkout or included in the listed price depending on how the product is displayed.

Payment authorization: By placing an order, you authorize us (and our payment partners) to charge your selected payment method.

Order acceptance: An order is considered accepted when we confirm it (or ship, depending on the item). We may refuse or cancel an order for reasons such as suspected fraud, incorrect pricing, stock issues, or address verification problems etc.

Product information: We try to display colors, sizes, and details accurately, but color, screens and photography can vary. Slight differences in color/texture may occur. 

Digital goods (if any): For downloadable items, access details are typically delivered electronically. Please ensure your email address is correct.

4) Shipping, delivery, and risk of loss


Delivery estimates: Any timelines shown are estimates only and can change due to carrier delays, weather, holidays, customs, or unforeseen events.

Address accuracy: You are responsible for providing a complete and accurate shipping address with landmark and pin code. If a parcel is returned due to an incorrect address, you may be responsible for reshipping fees and/or any other losses and additional chargers.

Risk of loss: Unless required otherwise by law, risk transfers to you upon delivery to the carrier or upon delivery to your address (depending on the shipping terms used for your order). If an item arrives damaged, contact us promptly with open video, photos and the packaging.

International orders (if available): You may be responsible for customs duties, taxes, or import fees imposed by your country and other charges, if any.

5) Returns, replacements, and refunds


Return eligibility depends on the product type and condition, and on what is permitted under applicable consumer laws.

  • Damaged or incorrect items: Please contact us as soon as possible after delivery with order details, photos, and a description of the issue. We will review and, where appropriate, arrange a replacement or refund.
  • Change-of-mind returns: If we accept change-of-mind returns for a product, the item must be unused, in original condition, and returned with original packaging. Shipping fees may be non-refundable unless required by law.
  • Non-returnable items: Custom-made/personalized artwork and certain limited-edition items may be non-returnable (unless damaged/defective or required by law).
  • Refund method: Approved refunds are generally processed to the original payment method. Processing time may vary by payment provider/bank.

6) Custom art requests (commissions)


Custom artwork is made to your specifications and often involves planning time and materials.

  • Scope: The scope, style, size, reference material, timeline, and price must be agreed before work begins.
  • Approvals: Where previews/mockups are provided, you are responsible for reviewing and approving them. Once approved, later changes may incur additional charges.
  • Deposits: A deposit may be required to confirm a custom order. Deposits are generally non-refundable once work begins, except where required by law.
  • Cancellations: If you cancel after work has started, you may be charged for work completed and materials used.
  • Delivery: Timelines are estimates and can change depending on complexity, revisions, and shipping constraints etc.

7) Copyright, trademarks, and intellectual property


All website content (including but not limited to text, graphics, logos, paint, image, art, frame, layout etc) is owned by SoulArt, used with prior written permission and is protected by applicable intellectual property laws.

Artwork rights: Unless explicitly agreed in writing, purchasing an artwork generally grants you ownership of the physical item (if applicable) but does not transfer copyright. We (or the artist) may retain the right to display the work in portfolios, social media, and promotional material etc, unless otherwise agreed in writing.

Personal use: No one is permitted to reproduce, distribute, sell, or create derivative works from our content/artwork without written permission.

DMCA / copyright claims: If you believe content on our site infringes your copyright, contact us with concrete proof and details sufficient to identify the material and your rights.

8) User content (reviews, messages, uploads)


If you submit content (such as reviews, comments, images, or reference files for custom work):

  • you confirm you have the right to share it
  • you agree it will not be illegal, abusive, hateful, defamatory, or infringing
  • you grant SoulArt a limited license to use it only as needed to provide services (for example, producing your custom artwork) and to display reviews with your consent where applicable

We may remove or refuse to publish user content at our discretion, especially if it violates these Terms or any law.

9) Privacy & data protection


Your use of our site is also governed by our Privacy Policy.

In general, we may collect information you provide (like name, email, phone, shipping address etc) and technical data (like device/browser information etc) to:

  • process orders and provide customer support
  • prevent fraud and secure transactions
  • improve our website and services
  • send important service messages (order updates, policy changes)

Marketing: We will not send marketing messages where consent is required unless you opt in. You can request removal from marketing communications anytime.

10) Disclaimers


Website availability: We aim to keep the website available, but we do not guarantee uninterrupted access. Maintenance, updates, or events beyond our control may cause downtime.

Information accuracy: We try to keep content accurate and up to date, but we do not guarantee that all descriptions or information are error-free.

External links: Links to third-party websites (if any) are provided for convenience. We are not responsible for third-party content or practices.

Artistic nature: Handmade and artistic products can naturally vary. Minor imperfections and variations can be part of the work’s character and are not necessarily defects.

11) Limitation of liability


To the maximum extent permitted by law, SoulArt will not be liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of the website or purchases.

Where liability cannot be excluded under applicable law, our liability is limited to the minimum permitted and, where applicable, to the amount paid for the relevant order.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.

12) Indemnity


You agree to indemnify and hold harmless SoulArt from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms
  • your misuse of the website
  • your violation of any law or third-party rights
  • content you submit that infringes rights or causes harm

13) Governing law & dispute resolution


These Terms are governed by the laws of India, without regard to conflict-of-law rules.

Before initiating formal proceedings, you agree to contact us and allow a reasonable opportunity to resolve the matter informally.

If a dispute cannot be resolved, it will be subject to the exclusive jurisdiction of competent courts in India (as applicable to the matter, in major case Ahmedabad jurisdiction).

14) Changes to these terms


We may update these Terms without any prior notice from time to time. Changes take effect when posted on this page unless stated otherwise.

If changes are material, you have to refer our website; we may provide additional notice (for example, a message, verbal message, website banner or an email etc where appropriate)

Your continued use of the website after updates means you accept the updated Terms.

Custom work usually involves time and materials. If you cancel after work starts, you may be charged for work completed and materials used. Deposits are typically non-refundable once work begins (unless required by law).

Unless we agree otherwise in writing, you own the physical item, but the copyright remains with SoulArt and/or the artist. This means you generally can’t reproduce or resell the design as prints/merch without permission.

Please contact us as soon as possible with open video and proper photos of the item and packaging, and your order number. We’ll review and arrange the best solution as applicable.
